Comment on the following: Once delisted, a company can not be listed again

Answer & Explanation:

An application for listing shall not be made in respect of any equity shares: Which have been delisted under voluntary delisting or by operation of law except delisting of small companies, for a period of five years from the delisting. Which have been delisted under compulsory delisting, for a period of ten years from the delisting. However, this shall not be applicable where a recommendation for listing has been made by SEBI for Industrial and Financial Reconstruction under the Sick Industrial Companies (Special Provisions) Act, 1985. While considering an application for listing of any equity shares which had been delisted the recognized stock exchange shall have due regard to facts and circumstances under which delisting was made. An application for listing made in respect of delisted equity shares shall be deemed to be an application for fresh listing of such equity shares and shall be subject to provisions of law relating to listing of equity shares of unlisted companies.
