Hemant Patel, a real-estate broker, lived in Delhi with his wife and two children. He owned a bungalow in Karol Bagh which was insured with Elite Insurance Company, New Delhi, for ₹ 35 lakh. On December 31st 2024, Hemant went to the local club with his family to attend a New Year party. When they returned home in the early hours of the next day, they found that their house was burgled and many valuables were taken away. While the police investigation was going on, the insurer sent his surveyor to look into the cause of the loss, the compliance of the insured with the terms of the policy, and the amount of loss suffered by the policyholder. During the course of investigation, the surveyor observed significant discrepancies in the statements given by the insured. These discrepancies pertained to the list of items reported to have been stolen and the mismatch between the true value of these items and the amount supposedly involved in the burglary. When the surveyor submitted his report to the insurance company, he mentioned that the financial condition of the insured was not good before the burglary and he had increased the insurance coverage on his house just a few days before the burglary took place. Hemant's claim form was therefore rejected by the insurance company on the grounds of fraud. Hemant filed a lawsuit against the insurance company. Why do insurers make payments for suspicious claims ?
Answer & Explanation:
Insurers often make payments towards suspicious claims, even when they have doubts, for several reasons: Fear of being blamed for tardiness in claim settlement: Insurance regulators and consumer protection bodies closely monitor claim settlement ratios and timelines. Delays in settling claims, even suspicious ones, can lead to penalties, reputational damage, and negative publicity. Fear of loss of goodwill: Prolonged disputes over claims, especially if they go to court and are lost by the insurer, can severely damage the insurer's brand image and customer trust. This can lead to a loss of future business. Need to maintain good standing with insurance regulators: Regulators expect insurers to handle claims fairly and promptly. A high number of disputed or rejected claims, even if justified, might attract regulatory scrutiny. Hasty settlements of suspicious claims: Sometimes, insurers might opt for a quick settlement, even if they suspect fraud, to avoid the higher costs and uncertainties associated with legal battles, investigations, and potential adverse court judgments. The cost of litigation can sometimes outweigh the amount of a suspicious claim. Difficulty in proving fraud: Proving fraud in a court of law can be challenging, requiring substantial evidence and resources. If the evidence is not conclusive, an insurer might choose to settle rather than risk losing a court case and incurring legal costs on top of the claim amount. While insurers have a duty to protect the interests of all policyholders by not paying fraudulent claims from the common pool, the practical realities of business, regulatory pressure, and legal complexities sometimes lead them to settle suspicious claims.
