As a separate case, advise Bithin next course of action for having two director identification numbers.
Answer & Explanation:
Section 155 of the Companies Act, 2013 read with rule 11(1)(f) of the Companies (Appointment and Qualification) Rules, 2014, provides that no individual, who has already been allotted a DIN under Section 154, shall apply for, obtain or possess another DIN. Thus, Bithin has violated Section 155 and has to surrender additional DIN possessed by him. He has to file e form DIR-5 to surrender the extra DIN obtained by him explaining that the extra DIN was obtained by mistake and without any mala fide intentions with a declaration that he has never been appointed as director in any company and the said DIN has never been used for filing of any document with any authority.
